NOVELTY AND INVENTIVE STEP EVALUATION 
IN PATENT DOCUMENTS 2nd. Ed.

Many colleagues involved in Patent matters and interested in patentability criteria, asked us to provide a workshop about this patentability criteria, so now, we are organizing this workshop which will include practical cases in order to provide the participant enough knowledge to understand the Novelty and the Inventive Step concepts.

We hope you find it helpful an interesting, and you do your best to join us; it is not so common to include this kind of topics in a workshop, however for any professional involved in patent matters is imortant to deal correctly with them, because these ones are essentials to get the patent granting, specifically the INVENTIVE STEP criteria, as well known in Mexico as ACTIVIDAD INVENTIVA, NON-OBVIOUSNESS (in United States), INVENTIVE STEP (in Europe), SHINPO-SEI 進歩性 しんぽせい (in Japan). The evaluation of INVENTIVE STEP in Mexico is applying the “Problem-Solution Approach”, we will deal with the “Problem-Solution Approach” in this workshop.

Después de varias peticiones por parte de algunos profesionales, quienes están interesados en los criterios de patentabilidad para evaluar una patente, nos dimos a la tarea de organizar este Taller, el cual, permitirá al participante entender con mayor claridad los conceptos de NOVEDAD y ACTIVIDAD INVENTIVA, CONCEPTOS que ya habíamos definido de manera muy general en otra entrada.

Esperamos sea de su interés y se integren a dicho Taller, estos temas no son muy comunes de tratar en un Taller, sin embargo, son muy importantes ya que determinan la protección total de la invención por medio de la Figura Jurídica de Patente, más específicamente el criterio de ACTIVIDAD INVENTIVA (en México), NON-OBVIOUSNESS (en Estados Unidos), INVENTIVE STEP (en Europa), SHINPO-SEI 進歩性 しんぽせい (en Japón), criterio el cual, en la práctica mexicana comúnmente se evalúa por medio del “Método Problema-Solución”.
